INFORMATION TEXT REGARDING THE PROCESSING OF PERSONAL DATA

As YAPITEL MÜHENDİSLİK TASARIM İNŞAAT SANAYİ VE TİCARET ANONİM ŞİRKETİ (“Company”), we have prepared this Information Text to inform you about the processing, storage and transfer of your personal data within the scope of the Personal Data Protection Law No. 6698 (“KVKK”) and related legislation.

To Whom and For What Purposes May Your Personal Data Be Transferred Within Turkey?
Your personal data may be shared in compliance with KVKK and applicable legislation:
● With persons explicitly authorized in the legislation, including the Social Security Institution, as required by legal regulations and obligations. Furthermore, your personal data may be shared with Competent Persons or Public Institutions and Organizations upon a court order or a request from an authorized administrative authority.
● With our Suppliers, limited to the purposes of conducting employee satisfaction and loyalty processes, managing employee benefits and rights, performing audit/ethics activities, conducting finance and accounting processes, legal proceedings, business operations/supervision, occupational health/safety activities, procurement processes, organization and event management, contract management, supply chain management, foreign personnel work and residence permit procedures.
● With Yapı Merkezi Group Companies, limited to finance and accounting processes, business operations/supervision, and contract management.
● With Real Persons or Private Law Legal Entities, limited to communication processes, finance and accounting processes, business operations/supervision, sales processes of goods/services, organization and event management, and contract management.
Do We Transfer Your Personal Data Abroad?
● Your personal data may be shared with Overseas Project Sites/Campuses for purposes such as employee recruitment and placement, evaluation of employee candidate applications, audit/ethics activities, human resources planning, assignment processes, business operations/supervision, occupational health/safety activities, contract management, and providing information to competent authorities; with Infrastructure Providers for storage and archiving purposes; or publicly in open environments for communication, business operations/supervision, organization and event management, advertising/campaign/promotion processes.
● Your personal data may be shared via social media accounts that use foreign-based technical infrastructure and storage systems such as Instagram, YouTube, Facebook, Twitter, LinkedIn. You may access detailed information regarding your personal data through the privacy policies of these platforms.
How Long Are Your Personal Data Stored?
If a specific retention period is stipulated in the law or related legislation, your data must be kept for at least that period. If no such period is defined, your data are stored for reasonable durations limited, relevant, and proportionate to the purposes of processing.
What Are Your Rights Regarding Your Personal Data?
You have the right to:
● Learn whether your personal data are being processed,
● Request information if your personal data have been processed,
● Learn the purpose of processing and whether they are used in accordance with this purpose,
● Know the third parties to whom your personal data are transferred domestically or abroad,
● Request correction of incomplete or inaccurate personal data,
● Request deletion or destruction of personal data under the conditions specified in KVKK,
● Request notification to third parties to whom your data have been transferred regarding correction or deletion,
● Object to any outcome against you resulting from automated processing of your data,
● Request compensation if you suffer damages due to unlawful processing.
How Can You Exercise Your Rights?
You may submit your applications and requests regarding your personal data through the “Relevant Person Application Form” by:
● Sending an e-mail to [email protected]
● Applying in person with a valid ID,
● Sending a wet-signed application with a copy of your ID to Kızılırmak Mah. 1443 Cad. No: 25b İç Kapı No: 196 Çankaya / Ankara.
According to the Regulation on Application Procedures and Principles to the Data Controller, applications must include name, surname, signature (if written), Turkish ID number (or passport number/ID number for foreigners), residential or workplace address for notification, e-mail address (if any), telephone number, fax number (if any), and information regarding the subject of the request.
If the application is submitted on behalf of someone else, authorization must be proven (e.g., power of attorney). If the request concerns special categories of personal data, special authorization is required under Article 10 of the Regulation on Personal Health Data. Applications must include identity and address information along with identity-verifying documents.
Requests submitted by unauthorized third parties will not be considered.
How Long Does It Take to Respond to Your Requests?
Your requests regarding your personal data will be evaluated and answered as soon as possible and in any case no later than 30 days. Our response will be sent to the address or e-mail you provided, or through the same method used for submission, if applicable.
